1. Agreement to Terms
By accessing or using the services of Companion Senior Concierge ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and Companion Senior Concierge. We reserve the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of any changes.
2. Description of Services
Companion Senior Concierge provides non-medical senior care and companionship services, including but not limited to:
- Transportation assistance
- Companionship visits
- Personal errands
- Grocery shopping assistance
- Medication pickup and delivery
- Appointment escorting
- Care coordination
- And other non-medical support services
Important: Our companions are not medical professionals and do not provide medical care, nursing services, or medical advice. For medical needs, please consult with licensed healthcare providers.
3. Eligibility
To use our services, you must:
- Be at least 18 years of age or have parental/guardian consent
- Have the legal authority to enter into this agreement
- Provide accurate and complete information during registration
- Comply with all applicable laws and regulations
4. Service Agreement and Scheduling
Initial Consultation
All new clients will receive an initial consultation to assess needs and create a personalized care plan. This consultation helps us match you with the most suitable companion.
Scheduling and Cancellation
- Services must be scheduled in advance
- Cancellations require at least 24 hours notice
- Late cancellations (less than 24 hours) may incur fees
- We reserve the right to cancel services due to safety concerns or unforeseen circumstances
Minimum Service Hours
Most services require a minimum of 2-4 hours per visit. Specific minimums vary by service type and location.
5. Fees and Payment
Pricing
- Rates vary based on service type, location, and scheduling requirements
- Custom quotes provided during consultation
- Rates subject to change with 30 days notice
Payment Terms
- Payment due upon receipt of services or as specified in your service agreement
- We accept cash, check, credit card, and ACH payments
- Late payments may incur additional fees
- Outstanding balances may result in suspension of services
Refund Policy
Refunds are handled on a case-by-case basis. If you are unsatisfied with our services, please contact us immediately so we can address your concerns.
6. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about care needs
- Maintain a safe environment for our companions
- Treat companions with respect and dignity
- Inform us of any changes in health status or care needs
- Provide access to necessary facilities and equipment
- Be present or arrange for authorized representative during services
- Pay for services as agreed
- Follow all safety protocols and guidelines
7. Companion Standards and Background Checks
All Companion Senior Concierge companions undergo:
- Comprehensive background checks
- Reference verification
- Professional training in senior care
- CPR and first aid certification
- Ongoing education and evaluation
While we thoroughly vet all companions, we encourage clients to report any concerns immediately.
8. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount paid for services
- We do not guarantee specific outcomes or results
- We are not responsible for medical decisions or healthcare outcomes
- We maintain appropriate insurance coverage as required by law
Medical Emergencies: In case of medical emergency, call 911 immediately. Our companions are trained to assist but are not medical professionals.
9. Insurance and Long-Term Care Coverage
While our services are typically private pay, some long-term care insurance policies may provide coverage. We will:
- Provide detailed invoices for insurance submission
- Assist with documentation as needed
- Not bill Medicare or Medicaid directly
Clients are responsible for payment regardless of insurance reimbursement.
10. Confidentiality and Privacy
We are committed to protecting your privacy and maintaining confidentiality of all personal information. Our handling of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
We comply with HIPAA regulations when handling protected health information and will only share information as necessary for care delivery or as authorized by you.
11. Termination of Services
Client Termination
You may terminate services at any time with 24 hours written notice. You are responsible for payment for all services rendered up to the termination date.
Company Termination
We reserve the right to terminate services if:
- Payment terms are not met
- Client or family members engage in abusive or threatening behavior
- Safety of our companions is at risk
- Client needs exceed our service capabilities
- Terms of service are violated
12. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of Companion Senior Concierge or its licensors and is protected by copyright and trademark laws. You may not:
- Copy, modify, or distribute our content without permission
- Use our trademarks or branding without authorization
- Reverse engineer or extract source code from our website
13. Prohibited Conduct
You agree not to:
- Harass, abuse, or threaten our companions or staff
- Request companions to perform tasks outside their scope of service
- Attempt to hire our companions directly without going through our company
- Provide false or misleading information
- Violate any applicable laws or regulations
- Use our services for any unlawful purpose
14. Dispute Resolution
Informal Resolution
We encourage you to contact us first to resolve any disputes informally. Most concerns can be addressed quickly through direct communication.
Arbitration
If informal resolution is unsuccessful, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law.
Governing Law
These Terms are governed by the laws of the state(s) in which we operate, without regard to conflict of law provisions.
15. Indemnification
You agree to indemnify and hold harmless Companion Senior Concierge, its officers, employees, and companions from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your violation of any law or regulation
- Your infringement of any third-party rights
- Conditions in your home that cause injury to our companions
16. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or posted prominently on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Companion Senior Conciergeregarding our services.
